Version: 1.0 · Effective: the date of first publication on the Service · Last revised: 31 October 2026
Part 1. About These Terms
1.1Thank you for visiting. These Terms of Service ("Terms") set out the basis on which the goat.fun team ("we", "us", "our") makes goat.fun available at https://goat.fun, together with every page, interface, tool, feed, display, communication channel and related feature that refers to these Terms (together, the "Service").
1.2We have tried to keep this document readable. Some Parts share responsibility and risk between you and us, or restrict what may be claimed if something goes wrong; their headings make them easy to find, and we ask that you read them closely.
1.3You accept these Terms when you first do any of the following: open or browse the Service; connect a wallet or other software to it; sign any message it presents; create, trade or interact with any token through it; post, upload or react to anything on it; or use any other feature it offers. If you are not willing to accept these Terms in full, we ask that you do not use the Service.
1.4Where you act for a company or other organisation, you confirm that you have authority to commit it to these Terms, and references to "you" include that organisation.
1.5We may publish further rules, guides, notices or feature-specific conditions that refer to these Terms. They form part of our arrangement with you. If one of them conflicts with these Terms on a matter specific to the feature it covers, it prevails for that feature, and only to the extent needed to resolve the conflict.
Part 2. Words We Use
2.1In these Terms, the following expressions have the meanings given below. Each is to be read broadly and in line with its ordinary commercial sense.
- "Network" means any public, permissionless distributed ledger, blockchain or comparable system, together with its validators, programs, protocols and related infrastructure, none of which we own, operate or control.
- "Wallet" means any software, hardware, extension, application or other means by which you hold keys, authorise messages or approve transactions on a Network.
- "Token" means any digital asset or record that exists on a Network, whatever it is called and however it is represented.
- "User-Created Token" means any Token whose creation is initiated by a user through the Service, together with any name, ticker, image, description, link or other information associated with it.
- "Creator" means the person who initiates the creation of a User-Created Token.
- "Platform Features" means the presentational and automated elements of the Service, including any ranking, ordering, designation, title, label, badge, progress indicator, featured placement, animation, sound, notification, performance display, and any automated process that allocates, applies or deploys amounts derived from fees or contributions, however named or styled from time to time.
- "Content" means any text, image, link, message, reaction, profile detail, call, reply, metadata or other material that you submit, post, upload or otherwise make available through the Service.
- "Third-Party Services" means any Network, Wallet, protocol, venue, market, aggregator, explorer, data source, price feed, hosting or communications provider, or other product or service that we do not operate, whether or not it is reachable from or displayed within the Service.
2.2Headings and the layout of this document are for ease of reading and do not change its meaning. Words such as "including", "such as" and "for example" introduce examples and never narrow the general words before them. The singular includes the plural, and the reverse. A reference to a policy or document is to that document as it stands from time to time.
Part 3. Who May Use the Service
3.1The Service is intended only for people and organisations to whom it may lawfully be made available. Because the rules that apply differ from one place to another and change over time, we depend on you to understand and observe your own position.
3.2Each time you use the Service, you confirm that:
(i) you have reached the age of majority where you live and have full capacity to enter into a binding agreement;
(ii) your use of the Service, and of each feature you choose to use, is permitted by every law, rule and requirement that applies to you, including those of any place where you are located, reside or hold citizenship;
(iii) neither you nor any person on whose behalf you act is the subject of any restriction, designation, listing or prohibition that would make your use of the Service, or our making it available to you, impermissible;
(iv) you are not using the Service from, and are not ordinarily resident in, any place in which making the Service or any of its features available would be restricted or prohibited; and
(v) you will not use the Service in any way that would place us in breach of any requirement that applies to us.
3.3The Service is made available generally. It is not aimed at, promoted to, or meant for anyone to whom it may not lawfully be offered, and nothing on it, or said about it by anyone, is an offer or invitation in any place where such an offer or invitation would not be allowed.
3.4We may, as we see fit, limit, condition or withhold access for particular places, persons or categories of person, and we may use technical or procedural measures to do so. Any such measure exists for our own protection. It is not an assessment of your legal position, and its presence or absence does not change the confirmations you give in this Part. If you cannot honestly give them, please do not use the Service.
Part 4. What the Service Is, and What It Is Not
4.1We designed the Service to be simple, quick and enjoyable, and we take care over how it works. We also want to be candid about its character.
4.2The Service is a software interface. It allows users to create Tokens and interact with Tokens through Third-Party Services, to view information about Tokens and market activity, and to take part in social and presentational features. Where you create, buy, sell or otherwise transact in a Token, that transaction is carried out on a Network by protocols that we do not own or control, and it is authorised by you in your own Wallet.
4.3Unless we expressly say otherwise in a signed written document, we do not act, and the Service is not offered, as a custodian, exchange, trading venue, broker, dealer, market maker, counterparty, issuer, sponsor, underwriter, investment or financial adviser, fiduciary, payment or money services provider, bank or other financial institution, escrow agent, or agent of yours for any purpose. We do not take possession of, hold or control your Tokens or your Wallet, and we have no ability to move them on your behalf.
4.4Much of what the Service shows comes from Networks, from Third-Party Services, from other users or from automated processes. Information on the Service is offered for general information only. It may be partial, delayed, estimated, rounded, derived, simulated, out of date or, despite our efforts, wrong. It is not an official record of any balance, position, transaction, ownership or entitlement, and it should not be relied on as one.
4.5Some environments of the Service, including test, preview and demonstration environments, may display simulated, automated or illustrative activity, may use Tokens that have no value of any kind, and may be reset, altered or withdrawn at any time. Nothing shown in such an environment reflects real market activity.
4.6The Service, its features and its presentation will change over time. Any description of the Service, in these Terms or elsewhere, describes it in general terms at a particular moment, and is not a promise about what it will contain or how it will behave in the future.
Part 5. Wallets, Sign-In and Keeping Access Safe
5.1To use certain features you will need to connect a Wallet and, for some features, to sign a message that confirms you control it. Signing such a message does not by itself move any asset. It allows us to recognise your Wallet for a period, for example so that you can post, react, follow others or maintain a profile.
5.2Each transaction that the Service helps you prepare is presented to you in your Wallet for your review. You alone decide whether to approve it. Certain elements of a transaction, such as an address, a routing instruction or an authorisation relating to a particular element, may be prepared or supplied by us, and transactions may be relayed to a Network through systems we use. Preparing, supplying or relaying an element does not make us a party to your transaction, and it does not mean that we have checked whether the transaction suits you.
5.3We take sensible, proportionate steps to protect the parts of the Service we operate, and we refine them over time. Most of what keeps your assets safe, however, lies with you, your devices and the software you choose. You are responsible for:
(i) keeping your Wallet, keys, recovery phrases, devices, passwords and any other means of access secure and confidential, and for every consequence of their use, whether or not you authorised it;
(ii) checking each message and transaction carefully before approving it, including the amount, the Token, the destination and any settings such as slippage;
(iii) making sure that any information you give us is accurate and kept current; and
(iv) letting us know promptly at our X account, https://x.com/usegoatfun if you believe anyone has used the Service through your access without your permission.
5.4Keys and recovery phrases held only by you cannot be restored, reset or replaced by us or by anyone else, and actions taken by someone who obtains them cannot be undone. We encourage you to use dependable safeguards, keep secure backups, and treat that material as you would anything important that cannot be recreated.
5.5We may suspend, limit or end any session, profile or access, including as a precaution while we look into a concern about security, integrity, misuse or compliance with these Terms.
Part 6. Tokens Created by Users
6.1The Service lets users create Tokens quickly and with little effort. That openness is part of what the Service is for, and it also means that User-Created Tokens are the responsibility of the people who create, promote and trade them.
6.2Our role. We do not create, issue, sponsor, own, control, manage, audit, review, verify, approve, endorse or recommend any User-Created Token, its Creator, or anything said about it. The appearance of a User-Created Token on the Service, in any position and with any label or animation, is not a statement by us about its merits, legitimacy, legality, ownership, origin, quality or prospects.
6.3Creators. If you are a Creator, you confirm that you are entitled to use every name, ticker, image, description and link you associate with your Token; that none of it infringes anyone's rights, imitates or impersonates any person, brand, project or Token, or is false, misleading, unlawful or harmful; and that you are solely responsible for your Token, for anything you or others acting with you say about it, and for meeting every requirement that applies to you in connection with it.
6.4Information we host. Where we store or serve information associated with a User-Created Token, such as an image or a description, we do so as a convenience. We may decline, alter, restrict, stop serving or remove any such information at any time, for any reason, and doing so may affect how the Token appears on the Service and elsewhere.
6.5What we can and cannot change. We may decide whether, where and how any User-Created Token is shown on the Service, and we may hide, de-emphasise, label or restrict it. We cannot alter, freeze, reverse or remove a Token from a Network, and a Token that is no longer shown on the Service may continue to exist and to be traded through Third-Party Services.
6.6Independent markets. Any price, quotation, chart, market capitalisation, volume, liquidity, holder count or trading activity relating to any Token arises from the independent conduct of independent participants and from the operation of Third-Party Services. We do not set, support, stabilise, guarantee or take responsibility for any of it.
6.7Independent participants. Anyone, including Creators, early buyers, large holders and automated systems, may acquire, accumulate, hold, sell, promote, disparage, copy, imitate or otherwise act in relation to any Token at any time, without our knowledge, involvement or ability to intervene. That conduct may be automated, coordinated, opportunistic, mistaken, careless, deceptive or hostile, and its effects may be immediate, severe and permanent. Those effects are outside our control and are not attributable to us. We do not undertake to monitor, prevent, reverse, remedy, compensate for or comment on such conduct, and no conclusion about us or our intentions should be drawn from what any other participant does.
6.8Changes in a Token's arrangements. Third-Party Services may, according to their own rules, change how a Token trades, including by moving it to a different liquidity arrangement or venue once conditions they define are met. Any such change, and any arrangement concerning liquidity, is carried out by those Third-Party Services. We describe these arrangements in general terms for convenience only and do not guarantee that any of them will occur, operate as described or continue.
6.9Your decisions. Any decision to create, acquire, hold or dispose of a Token is yours alone, made on your own judgement and at your own risk. Please do not make such a decision in reliance on anything we or any other person has said, on the efforts of any person, on any Platform Feature, or on the Service continuing to exist.
Part 7. Rankings, Designations and Automated Features
7.1Many of the Service's Platform Features are there to make the experience lively and engaging. We hope you enjoy them. Please treat them as presentation and entertainment within the Service, and not as information on which to base a decision.
7.2Rankings and designations. The Service may order, rank, select, feature, title or otherwise single out particular Tokens, Creators or users, and may show progress indicators, comparisons, countdowns or animations that relate to them. These outputs are produced by proprietary methods that we may design, weight, vary, randomise, suspend or replace at any time without notice, and that we do not disclose. Outcomes are not known in advance, may differ between occasions and users, and may change at any moment. An earlier outcome is not an indication of any later one.
7.3Not an endorsement. No ranking, designation, label, placement or animation is an endorsement, recommendation, rating, forecast, invitation or assessment of any Token or person, and none of them indicates anything about a Token's value, quality, safety or prospects. No one has any right or entitlement to be ranked, selected, featured or kept in any position.
7.4Automated allocations. The Service may include automated processes, funded from a portion of fees or from voluntary contributions, that acquire, allocate or apply Tokens or other assets in connection with Platform Features. Whether any such process runs at a given time, and its timing, frequency, size, selection and form, are for us to decide; we may carry it out through whatever means we choose, and we may adjust, pause, limit or end it. The operation of any such process is not an undertaking to support, buy, hold or maintain any Token, does not indicate any view about any Token, and creates no right, expectation or claim for any person.
7.5Holdings that result. Any Token or other asset acquired or held as a result of a Platform Feature is held and managed on the basis we determine from time to time. Any description elsewhere of how such holdings are treated is a statement of present general approach only, is subject in full to Part 13, and is not a commitment as to retention, use, disposal, timing or continuation.
7.6Contributions. Where the Service lets you contribute assets to a Platform Feature, any contribution is voluntary, made by a transaction you approve, and final once made. A contribution is not a deposit, loan, investment, purchase, wager or payment for anything, and it gives you no ownership, share, return, claim, refund or other right of any kind in respect of the feature, the contributed assets or anything acquired with them.
7.7Where not permitted. If any Platform Feature may not lawfully be offered to you, it is not offered to you, and you should not use it.
Part 8. Charges and Creator Allocations
8.1We aim to make the cost of using the Service clear before you commit to anything.
8.2Charges. Using certain features, including creating a Token and transacting in Tokens, may involve charges payable to us and to others. The applicable charges, or the means of finding them, are made available in the Service before you proceed, and by approving a transaction you accept the charges it includes. Network fees and charges levied by Third-Party Services are set by those parties and are your responsibility. We may introduce, change or remove charges at any time, with effect for transactions approved after the change.
8.3No refunds. Charges are collected through transactions on Networks that generally cannot be reversed. Except where a refund is required by law that cannot be excluded, charges are not refundable, including where a transaction fails, produces an outcome you did not expect, or is approved in error. Any refund we choose to give in a particular case does not create an entitlement in another.
8.4Creator allocations. The Service may make available to Creators a portion of the charges associated with trading in their User-Created Tokens. Any such allocation depends on the operation of Third-Party Services, must be claimed by a transaction you approve, may involve Network fees, and is subject to the terms on which it is offered from time to time, which we may change, suspend or end. Amounts shown in the Service are estimates. No allocation is a salary, dividend, return on investment or payment for services, and we do not guarantee that any amount will accrue, remain claimable or reach you.
8.5Team supply and side wallets. The team's total supply of any token that the team issues or associates with the Service may be between 40% and 60% of that token's total supply. The team reserves the right to fund side wallets for the purposes of:
- supply control;
- sniper and bad actor deterrence;
- treasury; and
- team.
8.6Side wallets may buy, hold, sell or transfer tokens at any time and without notice, and their activity may affect prices, rankings and other users. Nothing in this Part obliges the team to disclose any wallet or holding.
8.7Taxes. You are responsible for determining and meeting any tax, reporting or similar obligation that arises from your use of the Service.
Part 9. Outside Services and Networks
9.1The Service works with, links to and displays information from Third-Party Services because we think doing so is useful to you. That is not an endorsement, recommendation, verification or acceptance of responsibility for any of them.
9.2Third-Party Services are run by independent parties under their own terms and practices. We do not control, operate or audit them, and we cannot guarantee their availability, accuracy, security, behaviour or continued existence. Any relationship you have with a Third-Party Service is between you and its provider.
9.3You choose whether to use any Third-Party Service and you do so at your own risk. You are responsible for understanding and complying with its terms, for the permissions you grant to it, and for withdrawing those permissions when you no longer want them.
9.4We may add, change, restrict or remove any connection with a Third-Party Service at any time, without notice or liability, and a Third-Party Service may itself change in ways that affect the Service, your Tokens or your transactions. Information from Third-Party Services, including prices and conversion rates, is shown substantially as received or derived, without verification or representation by us.
Part 10. How You Use the Service
10.1We want the Service to be fair and welcoming. The list below illustrates conduct that is not acceptable; it is not complete, and we may act on similar conduct that it does not describe.
10.2You agree that you will not, and will not try to, or help or allow anyone else to:
(i) use the Service for any unlawful purpose or in breach of any requirement that applies to you or to us;
(ii) manipulate or attempt to manipulate any market, price, volume, holder count, ranking, designation, allocation or other Platform Feature, including through trades with yourself or with persons acting with you, coordinated activity, multiple or disguised Wallets, or any other artificial means;
(iii) create, promote or describe any Token in a way that is false, misleading, deceptive or fraudulent, or that imitates or impersonates any person, organisation, brand, project or other Token;
(iv) take part in or promote any scheme intended to obtain assets, keys or information from others by deception, including phishing, fake support, fraudulent links and impersonation;
(v) post, upload or share material that is unlawful, infringing, defamatory, obscene, harassing, threatening, hateful, invasive of privacy, or designed to mislead, or that contains malicious code;
(vi) access, probe, scan, overload, disrupt or interfere with the Service or any system connected with it, or gain or attempt to gain access to anything not intended for you;
(vii) bypass, disable or interfere with any security feature, rate limit, moderation measure, access restriction or other control;
(viii) use bots, scrapers or other automated means to access, extract from or interact with the Service, or copy, mirror, sell, reverse engineer or create derivative works from it, except as we expressly allow or as applicable law requires;
(ix) send spam or unsolicited promotion, or use the Service's social features in ways we consider abusive; or
(x) do anything that, in our reasonable view, harms or risks harming the Service, its users or us, or brings the Service into disrepute.
10.3We may investigate suspected breaches and take any action we consider appropriate, with or without notice. That may include removing or holding Content, limiting features, muting, suspending or banning profiles, Wallets or connections, restricting the display of Tokens, and cooperating with lawful requests. We are not obliged to monitor the Service, and a decision not to act in one case does not prevent us from acting in another.
Part 12. Our Materials
12.1Apart from Content and material belonging to others, the Service, including its software, design, text, graphics, animations, names, logos and the arrangement of its elements, belongs to us or our licensors and is protected by applicable rights.
12.2While you comply with these Terms, we give you a personal, limited, non-exclusive, non-transferable, non-sublicensable and revocable permission to access and use the Service for its intended purposes. We keep all rights we do not expressly give you. Using the Service does not give you any right in any name, mark or other element shown on it.
Part 13. Statements, Plans and What Others Say
13.1We like to share what we are working on and what we hope to build. Talking about plans necessarily means talking about things that are uncertain, unfinished and sometimes never realised.
13.2Any statement by us or on our behalf that is not a statement of present fact, including statements about plans, intentions, features under consideration, timelines, mechanisms, how a feature is expected to behave, or how any holding is expected to be treated, is forward-looking. Such statements reflect a view held when they were made, are not promises, guarantees or offers, may change or be dropped without notice, and do not form part of these Terms. Please do not act in reliance on them.
13.3Statements by anyone other than us are not ours. Users, Creators, commentators, communities, automated accounts and media may describe, praise, criticise or speculate about the Service or any Token, including in channels connected with it. We do not adopt, endorse, check or take responsibility for any such statement, however widely it is repeated or however authoritative it appears. A statement is ours only if we publish it through a channel we operate.
13.4Our commitments to you are limited to those set out in the current version of these Terms and in any material we expressly publish as binding.
Part 14. Risks You Accept
14.1The Service is built on technologies that are capable, and also young, fast-moving, imperfect and largely outside anyone's control. We would like you to understand them before going further.
14.2You understand and accept that:
(i) digital assets, including Tokens created through the Service, are speculative and volatile; their market value can change quickly and substantially, up to and including a complete and lasting loss, and they may at times be difficult or impossible to sell;
(ii) Networks operate independently of us and may suffer congestion, delays, outages, reorganisations, forks, halts, attacks, upgrades or changes to their rules, any of which may affect Tokens, transactions and the Service;
(iii) transactions on Networks are generally final; a mistaken amount, destination, Token, setting or timing usually cannot be reversed by us or by anyone else;
(iv) prices can move between the moment a transaction is shown to you and the moment it is executed, and the outcome may differ from any estimate displayed;
(v) software, including the Service, the protocols it uses and your own Wallet, may contain errors, vulnerabilities or unexpected behaviour despite reasonable care, and these may be exploited by others;
(vi) other participants, including automated systems, may act in ways that are faster than you, adverse to you or intended to cause harm;
(vii) the legal and regulatory treatment of Tokens and related activity varies by place, is uncertain and may change, possibly with immediate or retrospective effect, and such changes may affect the Service or your ability to use it; and
(viii) the Service, or any feature of it, may become unavailable temporarily or permanently at any time.
14.3You choose to use the Service, and you accept these risks. Please only commit what you are fully prepared to lose, and only use the Service in a way that suits your own circumstances, obligations and judgement.
Part 15. Not Advice
15.1Nothing on the Service, and nothing communicated by us or on our behalf, is financial, investment, trading, legal, tax, accounting or other professional advice, and nothing is a recommendation, solicitation or endorsement to enter into or refrain from any transaction.
15.2We do not know your circumstances and do not assess whether anything is suitable for you. No communication is tailored to you. You should take independent professional advice suited to your situation before acting, and every decision you make is your own.
Part 16. Changes, Interruptions and Withdrawal of the Service
16.1We work to keep the Service available and running smoothly, and we put real effort into that. We are not able to promise it.
16.2The Service is offered on an "as available" basis and may be interrupted, slowed or suspended for maintenance, upgrades, security, capacity, failures of Third-Party Services, legal reasons or causes outside our control.
16.3At our discretion, and without obligation or liability to you, we may at any time change, reduce, reorganise, rename or move the Service; introduce, alter, pause or withdraw any feature, Platform Feature, integration or display; set or change limits on use; restrict or suspend access, generally or for particular users, groups or places, including as a precaution; and stop providing all or part of the Service, temporarily or permanently, with or without notice.
16.4Where reasonably practical and appropriate, we will try to give notice of significant changes, though we are not obliged to and it may not always be possible. We are not liable to anyone for any change, suspension, interruption or withdrawal, or for its consequences.
Part 17. Information and Records
17.1We try to handle information carefully and to collect what is reasonably needed. This Part describes our approach in general terms. We may also publish a separate notice about information, which would then apply alongside this Part.
17.2We may collect and process information needed to operate, secure, moderate, maintain and improve the Service, to communicate with you, to prevent misuse and to meet obligations that apply to us. This may include Wallet addresses and signed messages, profile details, Content, information about your interactions with the Service, technical information from your device and connection (which we may keep in a protected or transformed form for security and moderation), and preferences stored on your own device.
17.3We keep information for as long as reasonably needed for those purposes, or as long as we are required or permitted to, including to resolve disputes, enforce these Terms and protect the Service. Information may remain in backups, caches and logs after removal elsewhere, and may be kept indefinitely in aggregated or de-identified form. It may be processed and stored outside the place where you live, including by providers working for us.
17.4Records on Networks are public and lie outside our control and yours. They may be permanent, may be copied, analysed and linked by anyone, and generally cannot be changed or deleted by us or by you. Please treat anything you place on a Network as public and permanent.
17.5If you have rights in respect of information about you, you may contact us at our X account, https://x.com/usegoatfun to exercise them.
Part 18. What We Do Not Promise
18.1We build and run the Service with genuine care, to standards we think fit for what it is and how large it is, and we work to keep it reliable, secure and accurate. That care is sincere, and it is not a guarantee.
18.2So far as applicable law allows, we make the Service, the Platform Features and everything shown or offered through the Service available on an "AS IS" and "AS AVAILABLE" basis, including any faults, and we give no warranty, representation, condition or term of any kind about them, whether express, implied, statutory or of any other nature.
18.3Without limiting Part 18.2, we disclaim all implied warranties and conditions, including those of merchantability, satisfactory quality, fitness for a particular purpose, title, non-infringement, quiet enjoyment and accuracy, and any arising from a course of dealing, performance or trade usage.
18.4In particular, we do not warrant or represent that:
(i) the Service or any feature will be available, continuous, timely, secure or free from errors;
(ii) any information shown, including prices, balances, rankings and performance figures, is accurate, complete, current or reliable;
(iii) any defect or vulnerability will be found, disclosed or fixed;
(iv) the Service or anything connected with it is free from harmful components;
(v) any transaction will be executed, will execute at any price, or will produce any outcome;
(vi) any Platform Feature will operate, continue or produce any particular result; or
(vii) any Third-Party Service will work, remain available or act in your interest.
18.5No information or advice from us, in any form, creates any warranty not expressly set out in these Terms.
18.6The law in some places does not allow certain warranties or implied terms to be excluded. Where that is so, this Part applies only as far as the law allows, and you may hold rights that remain untouched by it. This document does not exclude or restrict our liability for fraud or fraudulent misrepresentation, for death or personal injury resulting from our negligence, or for anything else the law does not allow to be excluded or restricted.
Part 19. Extent of Our Liability
19.1This Part sets out how responsibility is shared between us. We make the Service available on this basis, and it is an essential part of our arrangement with you.
19.2To the fullest extent permitted by applicable law:
(i) we are not liable for any indirect, incidental, special, consequential, exemplary or punitive loss or damage, or for any loss of profits, revenue, business, opportunity, anticipated savings, goodwill, reputation, data, use or value, whether foreseeable or not, and whether the claim arises in contract, tort (including negligence), under statute or otherwise, even if we were told the loss was possible;
(ii) we are not liable for any loss or damage that results from, or relates in any way to: using the Service or being unable to use it; any change, interruption, suspension or withdrawal of the Service or any feature; any Token, including any User-Created Token, and any act or omission of its Creator; any act or omission of any other user, participant, automated system, malicious actor or Third-Party Service; any Platform Feature, ranking, designation or automated allocation, or its absence; any unauthorised access to any Wallet, key, device, account or record; any error, defect, vulnerability, exploit, delay or inaccuracy; any instruction or transaction, whether it is mistaken, sent to the wrong place, front-run, slow, unsuccessful or impossible to reverse; any reliance on information shown on the Service; any change in the price, value, liquidity, availability or treatment of anything; any event on a Network; or any cause beyond our reasonable control; and
(iii) our total liability to you for all claims together, arising out of or in connection with these Terms or the Service, will not exceed the greater of the charges you actually paid to us through the Service in the twelve (12) months before the event giving rise to the first claim, and one hundred US dollars (USD 100).
19.3These limits apply even if a limited remedy fails of its essential purpose. Where the law of a particular place does not allow a limit, that limit applies to the greatest extent allowed and the rest of this Part continues to apply. Nothing in this Part limits liability that cannot lawfully be limited.
Part 20. Your Indemnity
20.1You will indemnify the goat.fun team and its affiliates, together with each of their directors, officers, staff, agents, contractors, representatives and licensors, and will defend them and hold them harmless, against all claims, demands, proceedings, losses, liabilities, damages, costs and expenses, including reasonable legal fees, arising from or connected with: your use of the Service; any Token you create or promote; your Content; your breach of these Terms; your infringement of anyone's rights; your use of any Third-Party Service; or your failure to meet any requirement that applies to you.
20.2We may take sole control of the defence of any matter covered by this Part, at your cost, and you will cooperate with us. You will not settle any such matter that affects us without our prior written agreement.
Part 21. Events Beyond Our Control
21.1We are not responsible for delay or failure caused by events beyond our reasonable control, including natural events, fire, flood, disease, war, unrest, terrorism, industrial action, failures of power or communications, the failure, congestion or change of any Network, protocol, provider or other dependency, attacks, exploits and other malicious acts, and acts of any government or authority or changes in law.
Part 22. Ending Access
22.1These Terms apply from the moment you first use the Service until they are ended.
22.2You may stop using the Service whenever you wish. Doing so ends these Terms for your future use.
22.3We may suspend, restrict or end your access to all or part of the Service whenever we consider it appropriate, with or without prior notice and whether or not we give a reason, including to protect the Service, its users or us.
22.4When access ends, your permission to use the Service ends with it, and any profile, Content, records or features associated with you may be hidden, restricted or removed, without compensation. Ending access does not affect any Token on a Network. Parts 2, 6, 7, 8, 11, 13, 14, 15, 17, 18, 19, 20, 21, 22 and 23, and any other provision which by its nature should continue, survive the end of these Terms.
Part 23. Resolving Disagreements, and General Terms
23.1Talk to us first. If you have a concern, please contact us at our X account, https://x.com/usegoatfun before anything else. Many issues can be settled quickly and informally, and we would much rather do that. You agree to allow at least sixty (60) days for a good-faith attempt to resolve the matter before starting any formal proceeding.
23.2Governing law. These Terms, and any dispute or claim arising out of or in connection with them or the Service, including non-contractual disputes or claims, are governed by the laws of the jurisdiction in which the operator is established, without regard to its conflict-of-laws rules.
23.3Forum. Any dispute that is not resolved informally will be finally resolved by binding arbitration or before the competent courts, as we may designate, in the jurisdiction in which the operator is established, and you consent to that forum.
23.4Individual claims only. To the fullest extent permitted, any dispute will be brought and resolved individually, and not as part of any class, collective, consolidated or representative action. If this restriction cannot be enforced for a particular claim, that claim is separated and dealt with in the applicable forum, and this clause continues to apply to everything else.
23.5Time limit. So far as the law allows, a claim that is not commenced within one (1) year after the events it concerns can no longer be brought.
23.6Changes to these Terms. We may revise these Terms from time to time. A revised version takes effect when it is posted on the Service, or on any later date it states. For material changes, we will take reasonable steps to bring them to your attention. If you continue to use the Service after a revision takes effect, you accept the revised Terms. If you do not accept them, please stop using the Service. The version and date at the top of this document show which version applies.
23.7Severability. If any provision is found invalid, unlawful or unenforceable, it will be modified to the minimum extent needed to make it enforceable while keeping its purpose, or, if that is not possible, removed. The remaining provisions continue in full effect.
23.8No waiver. A failure or delay in exercising a right is not a waiver of it, and exercising a right once or in part does not prevent its further exercise.
23.9Transfer. Your rights and obligations under these Terms are personal to you, and you need our written consent before passing any of them to someone else. We may pass on, delegate or novate any or all of our rights and obligations under these Terms without notice, for example as part of a restructuring, merger, acquisition or sale of assets.
23.10Entire agreement and non-reliance. These Terms, with any documents they expressly incorporate, are the whole agreement between you and us about the Service and replace any earlier or concurrent understanding, communication, representation, statement or material of any kind, whether written or oral, including anything said in any chat, post, video, call, interface text, announcement or other channel. You confirm that in accepting these Terms you have relied only on what they expressly say, and not on any other statement, promise, assurance, description, expectation or understanding, from any source.
23.11Relationship. You and we are independent of each other. These Terms do not make either of us the partner, joint venturer, employee, agent, trustee or fiduciary of the other.
23.12Third-party rights. These Terms are for the benefit of you and us. Except for the persons referred to in Part 20, no one else has any right to enforce them.
23.13Notices. We may notify you through the Service itself, through contact details you have given us, or in another reasonable way. Please send notices for us to our X account, https://x.com/usegoatfun.
23.14Language. These Terms are written in English. Any translation is for convenience only, and the English version prevails if they differ.
Part 24. Reaching Us
24.1Questions about these Terms are welcome at our X account, https://x.com/usegoatfun. Every message is read, and we aim to answer within a reasonable period, though no reply time is guaranteed and nothing in our correspondence alters these Terms.
